iPhone - never activated - needs repair - am I SOL?

I've got an unlocked/jailbroken iPhone that I purchased as a refirb online. A dead spot has appeared on the lower third of the touch screen rendering it useless. I was able to restore the phone to firmware 1.1.4 and installed the original AT&T SIM card. I'm hoping that I can take it to the Apple store and get a replacement next time I'm in the States. I've heard that people have been told at the Apple stores that the phone has to be activated to get a replacement (or get it repaird), however the Online Service Assistant at Apple.com states this:

Our records indicate this product has not been activated. Learn how to activate your iPhone. Please note that warranty service is not dependent on activating your iPhone. For more information, please contact us.

Anyone have any thoughts on this? You think they're gonna give me a hastle?

Well, it sounds like the formal Apple view is that you are OK whereas 'people' say it's not. I'd go with the official view.

Anyway, what is 'SOL'?

As long as you have proof of purchase, you're fine. Any Apple Store will probably swap it out without a second thought.
