I have two iPods (30GB and 40GB 3G) and both have less than half of their original battery life (one only two hours). Under the terms of the settlement, I'm expecting two $50 Apple store credits that I will use to buy either a shuffle or something else from Apple.

Who else here is expecting a credit? Can you post here when you get it?

This isn't an answer but a statement that I ran the suggested test for battery life on my third generation 15G iPod, was satisfied with the results, and decided not to file a claim with the Company.

I filed quite some time ago. We own 5 ipods (3 minis, a 2G and ... it must be a 4th generation one. It's whatever was pretty new last Christmas). The 2G has had its battery replaced -- wouldn't hold a charge for beans. So I'm looking forward to the settlement.

I didn't have the issues others are reporting, so didn't file.

Now I hope they fix the new color iPods that need hard reset when paused on audio books/enchanced podcasts. Assuming it is an Apple issue and not something the content providers are doing wrong.

Ah, I haven't been around here for a while. Glad to know I'm not the only one that gets that. What's the limit? Pausing for a short while seems ok. But if it goes more than a couple minutes, it dies. :-(

I didn't fill any claim.

I have a 10GB iPod (2G) since Aug/2002 and the battery is still good.

I have a 10G/1st gen, and the battery's still good, though I don't use it often for extended periods. I didn't file a claim.

My first gen iPod (5GB, moving clickwheel) still retains a solid 8 hrs battery life, despite heavy use over the past 3 years. I couldn't be happier. Consequently, I did not file a claim. I know that most of the posts re: battery life on these forums come from those with problems, so I thought I'd just share my success story. ymmv.

On October 24, 2005, a notice of appeal was filed in the Superior Court of California, County of San Mateo, against the approved iPod Settlement. As a result, Settlement benefits will not be provided unless and until the appeal is resolved. This could take an extended period to time (up to a year or more). Until that time, Apple's normal policies are in effect. Please check this website periodically for updates regarding the status of the appeal.

My 2nd Generation 15GB iPod runs for about an hour, max. Should we expect the new iPod to have a similar battery-life? I mean, are they using the same batteries on the fifth generation iPod?

I don't believe anyone has received anything yet.

But, to answer the original question, I've never had a problem with any of my iPods (6 so far), so I didn't file.

I am not at all surprised we have not received anything yet - or that we ever will. I find it odd that Apple would have waited so long to file an appeal.

looks like it'll be a while "up to a year or more" uggg... well i broke down and got a new video ipod and i love it. mabee someday we will hear something back about the claim. im not going to hold my breath though.

I want to take advantage of the 10% for turning in the iPod to Apple for recycling or sell it on eBay. I already filed a claim expecting a refund by October 2005 but nothing came. Can I take back my claim?

Not owning the iPod is not a reason to rescind your claim. The claim is still valid. The new owner cannot claim it anyway.
