Im sending off my black and white 3rd generation Ipod to apple as it is broken. will i get a 3rd generation back or will it be the newest ipod model out. thanks

You'll get a 3G one back (at least I always have, even after they changed to the color 4G models).

I'm rather sure you will get a 3rd gen. gen back, but if they are out, they will bump you. Whatever costs them less.

I hope the original poster didn't count on Apple being that generous. Some retailers may sell you a replacement plan that will provide a new replacement in the event of a malfunction, but Apple certainly won't. The best one could hope for would be a previous generation refurb from the stock of refurbs the Apple Store lists online.

Occasionally people are given a brand new model when they've had a lot of problems with their old ones, but it's certainly not standard procedure.
