iTunes purchases forbidden use on phones

I don't know when the statement about using music on a phone appeared in the iTunes 'Terms of Service' contract :-
Usage Rules.
(i) Your use of the Products is conditional upon your prior acceptance of the terms of this Agreement.
(ii) You shall be authorised to use the Products only for personal, non-commercial use, and not for redistribution, transfer, assignment or sublicence, to the extent permitted by law.
(iii) You shall be authorised to use the Products on up to five iTunes-authorised devices at any time.
(iv) You shall be able to store Products from up to five different Accounts on certain devices, such as an iPod, at a time.
(v) You shall be authorised to burn an audio playlist up to seven times.
(vi) You shall not be entitled to burn Video Products.
(vii) You shall be entitled to export, burn (if applicable) or copy Products solely for personal, noncommercial use.
(viii) You may not use Products as a musical "ringer" in connection with phone calls.
It think this is new, and seems to point to having to pay for 'ring tones' in the future.

The "Product" is the digital file you purchased. Burn it as an audio file and the rip it to MP3. New file! Not "Product!" 'Course you wouldn't use the whole song-that would be stupid! Find about a 10 second part and use a good editor to isolate it, then put it on your phone. My RAZR has particular requirements for these files, but I found Motorola's (unfortunately Windows only) software online for cheap, and it includes a good editor that automatically formats files appropriately.
I use a number of clips from CDs I've ripped, and there's nothing in the CD's license that says I can't do that.

This is why I'll only buy music on CD and not online. It isn't bitrate limited and doesn't come with a shrinkwrap agreement. Once I rip the CD to my computer I can do whatever I want with it at whatever bitrate in whatever audio format I wish to use.

That stipulation has been there since a while before the iPhone came out (although after it was announced).
