How to tell if iTouch has January Update without opening the box?

I just got a iPod Touch 32 gig from my local Apple Store. It's a gift so I don't want to open it and see if the January Update is already on it. Is there a way to tell if it might already have it? The person at the Apple store said it probably does but I'm not sure they were too sure.

Is there a way by looking at the serial # that's on the back of the box or something? Is the picture on the box different if it has the update (this has John Lennon's pic on the box). Or is the UPC # different?

I mean I guess I could let the person that I'm giving it to open it and if it doesn't have the update then bring it back to the store and demand the update for free or a new one with the update... but that would be dumb and an anticlimactic unboxing.

I had this issue when I got my iMac this past Xmas. The guy said it came with Leopard installed. Well there was a Leopard DVD in the box and Tiger in the iMac at least it didn't cost me anything other than 45 minutes of my time.

I'd assume it does have it, since the 32GB touch was introduced after the January update.

All 32GB touches have the January Update.

If it was purchased after the January update and you have the receipt, what's the big deal if it came with the update installed or not? Apple would still provided you with it.

No, they are mixed. I have an old one that's Lennon, and my friend who bought his with my has Macy Gray. No difference.

as long as it was purchased after the update even if the update is not installed it should allow you to install it free of charge. at least tahts what the apple store told me
