So I know this is really a question that AT&T should be alble to answer but seeing ask I asked 3 of their employees and got 3 different answers I'm gonna try asking here to see if anyone has done this.

So I have a cheap Samsung phone whose upgrade time is 4/2010
My brother has an original iphone he can upgrade now but doesn't want to (he doesnt think his next phone will be an iphone)
We are on a family plan together. I will be moving off it keeping my number

I've been told by a few people ( including AT&T) that if my bro says its ok I can take his upgrade time. so I would only have to pay 199 ( i want the 16gb) and also would not have to pay any sort of early termination fee on the samsung.

The difference between the rest of the answers I got from AT&T are as follows

1. My brother would then receive my upgrade time in july 2010
2. My brother would have to also restart a new 2yr contract
3 I would get the iphone 16gb for 299 and I don't even have to switch upgrade times

I know number 3 probably isn't true I have a feeling the guys though I wanted the 8gb

Out of answers 1 and 2 does anyone know which is true?

well the answer is that my bro has to get another 2yr contract but I keep my upgrade time. When my brother feels like updating he can use my upgrade.
