You're pressing the top button and it does nothing?

Press and hold the top button on the iPod for 5 sec. or until the 'Slide to power off' bar drops down. Slide this, to power off the iPod.
If this doesn't work then try resetting the iPod by holding down the Power and home buttons together.

No I tried really hard, for about 20 seconds I guess and it turn off. Yea, I believe more likely a hardware issue. Luckily, a new laptop arrived and I wish to move my itunes music and itouch songs to it--any ideas on easy ways to accomplish that?

Yes. Just copy the entire iTunes folder from the old machine to the same location on the new machine.
If the new machine is a Mac, let the Migration Assistant do its thing.
Otherwise, I suspect some spammer will be around shortly to recommend a free download of payable software to do a half-assed broken joy of copying stuff off the iPod.
