Fox denied pre-trial bid to shut down Dish Hopper DVR place shifting

A ruling by the US District Court for the Central District of California has handed Dish another court victory in just a handful of days regarding its Hopper digital video recorder technology. Fox Broadcasting has been denied a preliminary injunction on the Hopper's "Dish Anywhere" place shifting technology, as well as "Hopper Transfers" which can load DVR content on an iPad or other mobile device.

Fox had argued in the filing that the features violate transmission agreements signed between it and Dish, as well as violates the broadcasted media's copyrights. "We disagree that the harms caused by Dish's infringing services are completely compensable by damages, and as a result we are looking at all options. We will file a response in due course," said Fox in a statement regarding the ruling.

Dish executive vice president and general counsel R. Stanton Dodge said that "Dish is pleased that the Court has sided again with consumer choice and control by rejecting Fox's efforts to deny our customers' access to the Dish Anywhere and Hopper Transfers features. We will continue to vigorously defend consumers' right to choice and control over their viewing experience."

Last week, Judge Laura Swain of the Southern District of New York refused ABC's bid to kill the DVR and hobble its ad-skip feature prior to its separate trial about the technology. Today's victory is Dish's fourth victory regarding the Hopper DVR and related technology.
