ipod trademark violation?

I was under the impression that Apple had the trademark for the name "ipod". Well, I was searching around and found another company, Nonin Medical, has just released a product that they're calling "ipod".

I bet Apple's legal department won't let this stand for very long.

I think that trademarks apply on a per merket basis. So, there could be a iPod music player, iPod cap, or an ipod...medical...finger...thingy  , all coexisting since one doesn't compete with the others.

as long as they cannot be mixed up. No doubt another musical item called iPod would annoy apple, but you cannot confuse mp3 players with medial devices. Unless you play whale music.
Take Polo for example, there is a mint, car, game, tshirt. The thing is they are totally different and cannot be muddled up.
