Half scroll wheel on new 10 gb iPod?

I just bought a new 10 gb iPod and have noticed a not so funny "defect". About 50% of the scroll wheel is inactive or responds really shaky. The whole of the south west hemisphere either not scroll the menus at all when dragged or jumps through the menus in a haphazardly manner.

Have anyone else had a similar problem? I guess I'll probably have to take it back to the store where I bought it to get it repaired.

Yours is a dud. Send it back and get it fixed/replaced.
