This seems to be the case for the next ipod. I hope that HP will do something with the battery in the ipod. For some info go here http://www.macrumors.com/ They have a couple articles about it.

I noticed that the article says summer, which is quite a ways away. I'm thinking that Apple might revamp the entire iPod line by then, leaving HP to stay with the old inexpensive/less featureful 3rd gen. That would leave Apple open to make their iPods pro-level, with all those features that everyone has been drooling over.

There's not really anything that anyone can do about the battery, battery technology just hasn't kept up with electronics. The only thing Apple can do is find a slightly better supplier or increase the battery size. Either way, it will only make the price go up.

A consumer removable/replacable battery would be nice.
