i got a 40gb ipod in january. by last month the metal case was protruding approximately 1/16" out from where it had originally met the plastic portion of the case. i took it to my local apple store and they replace dthe unit. now, a matter of a few weeks later, the second unit is doing the exact same thing. it has not been bumped, dropped hit or abused in any way. it's seen no more than 60 hours of use in that time. it has been kept in a sfbags nylon case at all times unless being charged.
has anyone had a similar experience with their 40gb ipod?

Its happening to mine on the left side(if you were looking at the face). As was yours, mine was never dropped, hit or abused either. In anycase I don't see how this would happen if it was dropped because its more of a slight bend as if slight but constant pressure was applied in some way to make it happen.
I have't brought it to a store yet, but now that you got a new one, maybe i should do the same thing.

hey guys,,,
brought mine to the apple store here in minneapolis yesterday. the genuis was able to stick a thin plastic tool into the case and apply pressure to tabs on the plastic portion of the unit. they then popped it back into place. the repair took approximately five seconds. having watched him do it i can say anyone could fix this issue. he said they see it often – usually when a lot of pressure is applied to the top (face) of the ipod case.
