The 5 gig iPod has a capacity of about 4.64 gigs.
The problem stems from 2 different definitions of gigabyte. The one quoted above (generally the marketing definition) and the definition used by the technical folks.
Edit: My 5gb iPod has frozen once. Had to reset it, as described on apple's web site. Has worked fine since.
