Serious problem with OWC

I'm having a terrible problem with OWC at the moment. Given the good feedback I had on that company I ordered a few chips or RAM from them while I was staying in Mexico for a little while (I am French and live in Paris). International shipping was supposed to have a delay of 3-5 days and I was staying in Mexico city for 10 more days so I thought it would be ok. What happened is that OWC apparently made a mistake when filling some form and it got stuck at the custom. I battled with FedEx over the phone and they told me to contact OWC because they weren't able to reach them.
I emailed OWC 3 times asking them to get in touch with FedEx so I could get my package before leaving Mexico. Never got an answer...I couldn't phone them because international phone was too expensive.
I finally had to go back to France without my RAM :-(
Now I keep sending them emails and sending them faxes asking them to either reroute my package to France or give me my money back. I paid over $400 for something I never got. I am not pissed off because I trust them but I don't understand what's going on... As far as I can tell, the package is still at the custom in Mexico. I would at least expect them to answer me and tell me that they're working on it. It's been a month since I ordered now !
Does anyone have an idea of what I should do? I dont want to sue them or anything unless its really necessary..I just want my RAM or my money. As a student I can't allow myself to loose that much money.

Sounds like a FedEx problem, not an OWC problem. Have you contacted OWC by email? I can't believe FedEx put you off like that.

Yeah I've emailed OWC 3 times and faxed them also. No answer at all. FedEx told me OWC made a mistake when filling a form... darn I paid FedEx over $20 to send it in another country and they won't even give me feedback when something goes wrong.

If you used a credit card, as soon as you receive your statement write to the card company to contest the charges if you don't receive the goods. The card company should then withhold payment to OWC until the matter is resolved (at least that's the law in the U.S.). Bottom line: you don't have to pay for goods you never receive. Doesn't matter if it was OWC's or FedEx's mistake - if OWC promised to get them to you, it's ultimately OWC's responsibility. Let OWC fight with FedEx.
It was probably an innocent mistake - OWC seems like a good outfit - but if they promised to get the goods to you, you shoudn't have to pay them until they do.

I paid using a VISA card...but according to my bank account they charged me as soon as they shipped the goods. So you say that I should contest the charge? I hope that my bank won't cause any troubles, Im not sure about the laws here. I'll try one last time getting in touch with OWC and find a solution with them. If that fails I'll try what you said. Thanks...
I've also heard about something in the US called the "Better Business Bureau" that companies are afraid of...Should I threaten OWC of calling the BBB after them if they don't at least answer me and work with me to find a solution? Would it be efficient?

Have you called to talk to someone there? They are pretty good with customer service on voice calls.
Even thought your card was charged, if you call and dispute it with your credit card company, they'll suspend the charges on your bill while THEY investigate (meaning they will call FexEx, OWC, and do the legwork). If OWC is responsive to you, the Credit card company invetigating will help to expedite the process and in the meantime, this won't hold up credit on your end...

Lord Kur,
writing to the better business bureau is a good idea. when (and if) you file a complaint, this will be forwarded to the company of complaint. to show that they are in good business, they will respond back telling you their story. this will start some sort of conversation between you and the company. if this doesn't get resolved through the bbb, they [the bbb] will write them up. what this write-up does is warns future customers of this company and their dealings. even if this gets resolved in a matter of minutes of you reading this, it is still a good idea to complain.
