I thought Apple announced that MWToyko wasn't goint to see any new hardware? Isn't the new Apple HD Display classed as such.

I hope no-one thinks about sueing or asking for moneys back.

You could argue that both iPod and ASB23" are upgades/updates. what does everyone think?

Nope. They specifically said 'No new CPUs'. They mentioned nothing about 'no new hardware'.
