last week i weighed in on my experiences with my new 12" powerbook. i mentioned that i got it 3 weeks ago but i've only been able to use it for a week due to the fact that the latch simply didn't catch and, therefore, it wouldn't shut. it was at apple being repaired.

instead of sending it back via the box they send you, i took it to an educational depot in my city, they normally do great work for us, unfortunately, they can't fix laptop cases. they sent it back for me overnight. it was back in 5 days.

the unfortunate thing is it came back with a note attached "adjusted bezel?" and the tech at the depot called apple and apparantly they said something along the lines of "this is a known problem tell the user to press harder and DON'T send it back to us, we won't fix it." he told me that my only resort was to call apple and threaten them, and not to bring it back to the depot because they didn't want to play middleman in this "future mess."

it came back open. the tech then proceeded to slam it shut in front of me to show me how to forcefully close these "new" powerbooks. for a bit when i opened it back at work the display was wonky.

i read the previous threads on latch issues, and i have tried to tape open the latch mechanism overnight to loosen the spring, but frankly it doesn't seem like there's a strong enough magnet in mine.

i asked if i should return it to the apple store in which i bought it, but since it's 21 days past the purchase date and not 10, this is now a repair and not a replace. i have applecare, fortunately.

my question to anyone is: has *anyone* had this latch issue, and if so, what should i tell apple, or what should i ask for specifically when/if i call apple again? when i called applecare originally (and then decided to take it to the depot) i had to go through the third degree of "how did you break it? when did you drop it? how did you abuse it?" and they simply did not believe that it came this way (it did, i had a hard time closing it from the first day, however, i went on a long trip past the 10 day replace time. they gave me such a hard time on the phone and "i don't know when you'll get it back...probably a month, but don't ask me these things." that i'm terrified to send it back.

any advice would be appreciative. i'm trying to remain calm and rational considering this is the first mac to go back in almost 18 years.

Apple tends to have a hard time swallowing the fact that it's very possible one of their machines could leave the factory damaged, escp. w/ latch issues. Apple seems to be very unforgiving escp. to latches from other's experiences that I've read about. Your best bet is to take quick action and tell AppleCare your relatively new machine has been defective from day one, and that the issue is only getting worse and you'd like a repair under your AppleCare warranty. Try to remain calm as long as possible, and if you can't any longer, walk into an Apple Store w/ your machine and begin making a recuss...sure enough an employee will say almost anything to calm you down as long as you don't get to rowdy and you just might get your way.

My advice. Bring it to the nearest Apple Store, and try to convince them.
