not sure if this is a result of X.3.9 or if it just happened to die today, but I was just about to put a CD into my PowerBook to burn, and normally you just slide it in and you're good to go, well, I just tried to slide it in... and it's behaving like there's a CD inside... only there isn't. I ejected the last one I burned last night, so I KNOW there isn't one there, and OS X doesn't think there's one there. So yah...
Could this be software? Or is it definitely hardware? Glad I bought Apple Care

Define "behaving like there's a CD inside." Is there an icon on the desktop to a disk that isn't there? Do you mean you physically can't insert a disk or is it getting ejected immediately? The exact behavior of both the hardware and software are important bits of information for diagnosing a problem like this.

this exact thing just happened to me on thursday (before the 10.3.9 update). there was no disc inside my Superdrive, but a CD wasn't being pulled in. i checked Toast and my Superdrive wasn't being recognised (recorder not present). i tried to verify with Apple Systems Profiler, but that would hang.
what i did was reset the PMU. shut down, press shift-ctrl-option-power, wait 5 sec then powered up. Superdrive went back to life.
hope this solution works for you too.

Restart and see if the problem continues.

I don't even think I've restarted since then... though I might have, but today without thinking I bought a new CD and slide it in, after it took it my eyes bugged out... apparently the problem has fixed itself... anyone have a clue?
And it was simply not letting me put a CD in, like when a CD is normally in.

lucky you, glad to know it's fixed . for me, a regular restart didn't help, nor did zapping the PRAM, but a PMU reset did the trick.
