Hi there,
Here goes my story with my Macbook black.
Last October I bought a new macbook black here in Portugal, in a store that sells apple products.
After 2 or 3 days of using my new computer and being completely fascinated with it: no whining, mooing, excess heat, or any of the known problems that have been afecting these machines, I couldn't be happier.
Then my happiness vanished when I noticed a scratch in the kensington lock area. Called the store and turns out that my notebook had already been used in an exposition that the store had made.
They of course had to agree to replace the computer and I went to the store to do it. When I got there, they told me that they were all out of stock and that it had to be ordered and that I could keep this one with me until the new one arrived. I asked them to hand me a paper where they compromised to make the exchange no matter what time that would take, just in case.
Well, this was in the beginning of october and I am now still waiting for my replacement macbook. Have been using the first that I brought home but of course it's not the same thing as this is only a temporary thing.
After waiting all this time, I have called the store several times and they said they were still waiting for the macbooks to be delivered.
This was last week....no delivery prediction...but now, things changed.
The new macbooks are here and I feel really that it's terribly unfair if I have to get an "old" macbook when the new one is out, and also because for all that matters, the replacement was made in the 14 day period. If I still don't have it, it is not my fault since the store didn't have stock up until this day.
I called the store again today and they said that they still wouldn't know the exact time the macbooks get here, and they couldn't tell me if my replacement macbook will be one of the new ones or If I will be stuck with the older version.
Can someone help me out?
What can I do in order to get the new model...I am still waiting for the replacement unit that was taken care of in the 14 day period so I should have the right to the new model? Am I right?
Please give me some light...

Just call them and say instead of getting your replacement, you would just like to return the MacBook and get your money back. Then go to the store again (or buy from Apple online) and buy yourself one of the new models.

Already tried that approach but didn´t work.
They rubbed to my face that they let me keep this macbook while I wait for the new one, bla bla bla. Don´t really know what to do if they put an "old" model in front of me.
They can say that it is what I paid for...and yes they´re right, but that was 1 month ago and now things changed. If I get the older model as a replacement I will be getting a discontinued product and buying it as if it was the new model.
Same price - old model
That is not fair...

It sounds like a dishonest dealer to me. Scratches by the lock area does not soun good to me. Also, what kind of store would treat a customer this way? I suppose Portugal is a bit different from the US in this way.

You should contact "Apple Customer Relations" (ACR).

Perhaps they can impose on the local store to treat you with more respect and they can also be a third party to monitor the progress of the replacement order.

Apple only sells what is 'current technology'... ie: C2D macbook. if your order has not been shipped then i doubt they will give you the Core Duo model. Although you can never say for sure unfortunately...

But give ACR a go first... they should be able to help you or give you info on wether or not that store actually did make an order for you or wether they are just stuffing you around.

you have every right to be upset.... they were deceitful. You could even ask for your money back as was suggested in the previous response.
