So I bought my macbook back in july 1 gig of ram 100 gb hd for $1596 black by the way. Now they have the newer core 2 duo with 120 gb for 1399 with the student discount thats about 200 bucks. You think if i called apple and gave them a stink cause i dont think this is fair. You think theyll budge?

Apple's return policy is 14 days, and their "safety window" is 10 days, which means that if they refresh a product within 10 days of your purchase then you're eligible for a deal.
July 1st? I'm sorry, but that's way too far off. The computer industry has changed significantly since July. Also, what would Apple do with your old machine? And you'd be getting a brand new machine with a brand new warranty, which means you just got an extra 4 months of warranty for free.
So no, I don't think they'll budge. You bought what you bought (4 months ago(!)), and something newer came out. I could understand maybe if this is your first computer purchase, but like many have said, Apple is a business, not a charity.
And besides, the only thing you're missing out on is 64-bit capability. When it comes time the average consumer needs a 64-bit processor, it'll be past overdue for you to upgrade anyway.

Right. Do you think that it would be fair to Apple if they gave you a computer for free for four months? Don't worry, be happy. You've had a very nice machine since July and it's still a great machine. If you must have the latest machine all of the time, you'll either have to pay the price, or will always be disappointed.
However, you might find someone on eBay who'd buy your older machine for around $1100 dollars. Then you could pay the couple hundred extra for a new one.

Its not fair... that prices go down?
Should we all still be paying $5000 for G3 laptops with 10GB drives?
Would you expect a car dealer to let you return a 2006 you bought in July for a 2007 today?
Intel's roadmap (and the hard drive manufacturers) is no secret. It's available in rough form years in advance and with details months in advance.

But the Dell pocket DJ was a flop. I'm not surprised that had to give away freebies just to keep their customers happy.

Good analogies, my friend asked me the same thing after he bought his white macbook.

Don't feel bad, man. At least you didn't get an AlBook less than one month before the first MBP (which are rather bleh by now standards) came out.
Though I guess I shouldn't complain since I got it retail new for unbelievably cheap and somehow, the AlBooks retain quite a bit of resale value (moreso than RevA MBPs on ebay i think)

Here is my experience.
Customer Relations decided to replace my old Powerbook G4. The order was placed on October 17 I believe. It shipped on Oct 27, and it was received on Oct 31. The new MB C2D was released on Nov 8. I asked if they would upgrade me. They said No. I have written to ask for a replacement. I am waiting to hear back. I am quite doubtful that they will do it as they were very adament on the phone (both the Customer Relations person and his manager) to NOT give me an upgrade.
I do recognize that there are differences (my machine was a replacemnt vs a new purchase) but do not think that there is a difference here.
So based on that, your request will undeniably be rejected. Sorry man!

Only if you're having persistant hardware issues. I know of one case in particular where someone I know sent a new Mac in for repair several times within a few months period of it's purchase, and they made a big deal & were finally able to get a refund which they put twards a new model...
If your MacBook has no serious hardware issues that can't seemed to be rectified, then you got what you paid for. Your only real option is to sell it as used & put the money made twards buying the new model, but you aren't likely to make back enough to buy it straight out...
