No keyboard control after deep sleep

New MacBook, December Xmas present. if I close the lid at about 10% or so, usually by the next time I use it, the battery is dead. It is in deep sleep, so I plug in the power cord and get they grey screen and it comes back up, just where I left it.

However, I the keyboard is non functional. Logging out and back in do nothing, a full reboot is needed.

I read one report, thats all I could find, of this happening to someone else. They say to put it to sleep again, and wake it up.

I have third party ram, but this happened before I changed that as well.

Should I take this to the Apple store while still under warranty, or is this a known issue software will one day fix.
