In all likelihood, nobody would even be able to tell whether it was mocked up in IB or Photoshop. You'd be more likely to run into trouble for using Apple-copyrighted artwork (i.e. Aqua) on your Web site. That's how they got all the themers before.
They don't really seem interested in pursuing this kind of thing nowadays, though.
