Hi all,
I bought Final Cut Pro 4 this afternoon. The Apple Loops for Soundtrack CD was bad. There's a visible defect on it - it looks as if it was scratched while the plastic on the bottom of the CD was cooling since the scratch doesn't seem sharp, it has more of a dull appearance that you'd see if the plastic cooled around it. Obvious manufacturing error.

So now what? Bring it back to the store? They'd have to open another box. Am I stuck with sending this back to Apple, which could take weeks?

You bought from a store, not from Apple, so it's the store's business to provide you with a working product. They are the people you have the contract of purchase with (They will then likely then return it to Apple themselves).

Take the whole box with you and demand that they exchange it to a new one immediately. If they want to make you wait until Apple has exchanged it for them, make a third.
Nasrudin sat on a river bank when someone shouted to him from the opposite side: "Hey! how do I get across?" "You are across!" Nasrudin shouted back.

Except...I already registered FCP4. I don't know if that would cause any problems, especially since it's an upgrade. You know how stores are with opened software that have serial numbers.

If there's a visible defect and they're not blind they should see it. And they might want to keep their customers happy.
