So I look on the photoshop box in the store, it says: "This upgrade version of adobe photoshop CD and Adobe ImageReady CS is inteded for licensed users of Adobe Photoshop 7.0 or ealier." That's what it says on the side of the box. I went ahead and bought the product and opened the install window. When it loads it says, enter the serial from a verison of Photoshop 5.0 or higher. I have 4.0!!!! how was I supposed to know 5.0 or higher when all it said on the box was 7.0 or earlier. This is unbelievable, I'm trying to be calm, but I'm afraid I've just flushed a lot of money (for a college student at least) down the drain. Am I really in the wrong here??? anyone have any suggestions... this sucks.

As I see it, you have two options depending on how strict your moral code is:

1) Return it to the store, telling them of the misleading packaging. They probably won't let you return it b/c it's opened but it's worth a shot. You'll then have to return it directly to Adobe who shouldn't have any problem refunding your money. Or they may hook you up with a serial number if you remain calm and explain your case. You never know.

2) Find a 5.0 serial number and use it. They're out there, it just requires some searching.

They have to. They didn't sell what they said they are selling, so they have to return it. Doesn't matter whether it's opened or not. How could you know it doesn't include what's described on the packagin without opening it?

my moral code isn't to strict, I found a number, and installed and registered. Apparently Adobe could care less about the original serial when registering, all they want is the new product serial of the upgrade software. I then called the sales rep from GovConnection.com who I bought the software from. I told him exactly what happened and he said that even though I hacked the serial code it's a legal version as far as adobe is concerned... I figured I wouldn't raise too much hell because I do have what I paid for, but I do feel bad for stealing a serial number.
oh well.

I had to do the same thing many versions ago. Had 3.0 and jumped ... hmmm ... several versions. Then I found I needed a 4.0 serial number! (This was after an Adobe rep told me, on the phone, then 3.0 would work. I essentially found a 4.0 number and used it. Now I have duly registered later numbers and am fine. But I can still remember how incredibly aggravated I was.

Actually, no they don't. Most would to provide good customer service, but there's nothing that says a store has to accept a return here in the states. There's a reason caveat emptor is a popular expression here. And it would technically be Adobe conducting the 'fraud' by promising the software worked when it really didn't. The store sold it on good faith based on what Adobe said. Fair? Nope. But that's the way the system works.
