There is an item in my trash that says is still in use. Is there any way I can "override" it or something. I don't want it on my computer any more!

tried restarting then deleting it?

You could log out or reboot. You can also try "Secure Empty Trash" which is ruthless and deletes stuff that is still in use (fun when you delete a QuickTime movie while it is still playing).

Also you can try SuperEmptyTrash, don't confuse with TETENAL advice.
