I've scanned in a 8x10 color neg into photoshop.
how do i make the positive image from that?

That type of transformation really has to be handled at the scanner stage. What you have now is some negative image with little detail and a big orange cast compressed into 256 colours. Trying to invert the image in Photoshop and choose a new white point will not give satisfactory results.

Typically a decent scanner will have a negative look-up table to drop the orange mask entirely, choose the appropriate white balance and give you 256-bit depth for the actual colours in the image.
