Theoretically:

If someone owed you $2000 for making a website and they have not paid you after 4 months.

You have full access to their email.

You have full access to their FTP.

You know their home address and Cell phone number.

You know several lawyers that will do you a favour.

You have no real hope of seeing the money but want to screw them over something fierce.

Be realistic and creative!

I'd take their website down, and put a message up.

"Web site down pending payment", etc.

Perfect if it's a business.

Don't get dirty just yet, there is hope. You could still get the cash.

This Thursday is the absolute LAST day, then the nasty lawyer letter. Then we get it on something awful with website changes. And then small claims court.

I agree with Cipher. But make it sound like a system generated web page (clients will probably be too dumb to know its not).

Error: Webpage access restricted due to unpaid account. (Error 911)

Payment due: 1st December, 2003. If you believe this message to be in error, please contact the system administrator.

That way you don't get into trouble with the courts like you might if you start putting naughty things on their site.

You chaps are too nice. I found a former business associate of the client in question that got screwed out of $98,000 so I don't think it is time for nice.

I was thinking of a redirect to my site with "Mr. XXXXX is a thief owes, $2000 and here is his number if he owes you money also".

He doesn't like it he can take me to court and I will take the opportunity to get my money.

The best way to screw this person over is to take them to court and get your money.

Then soil their name. Make it known they are a cheat-publicly. Tell anybody and everybody. Ruin business for this person.

For instance, inform their clients, present and potential, about their questionable business practices.

It may only be two grand, but it's the principle of the matter.

Change all the passwords and take the site down (make it look like a system error). Wait for them to call you. Tell them you cannot do more work until they pay the balance.

You have no friends when they owe you money.

i'd say that if you did their website, that's punishment enough for them. but that wouldn't be nice of me, so i won't say that.

do they have a mailing list? mailshot the list, using the ditbag's email account, saying like "i am worthless, i don't pay people. i didn't pay Mark his money for something he spent time on, yadda yadda. if i didn't pay you either, please feel free to email me about it, and i'll issue the payment straight away" etc, so it looks like it's from him. take that site right down too. don't just remake the index page; delete the entire site from their server and put up a page like Jeremy suggested (nice email link there, Jeremy )

let us know how it goes. i can't stand people who don't pay up.

Buahhah!

But seriously, what's their lame excuse for not ponying up the dough?

Do something on their site like "The financial funding for this site hasn't been properly accounted for" or something silly.

Or....

As Jerry Seinfeld would say...

"Live Comfortably"

I would ask the guy to remove the content/design if he is not going to pay for it as you could potentially sell the design to someone else with a simple facelift.

Or, worse, the guy you did the work for could potentially give the job to someone else.

I pulled the site I did when he was 3 months late with payment and put his old one back up cuz I knew since he got what he wanted he thought he didn't need to pay me anymore. He kept begging me to put it back, fat chance.

Start misspelling words one by one. every day he doesn't pay, go into his site and creat a misspelling. Make him look like an idiot. Or, if it's a business, change all of his prices around. Make some wild claims. Have a sale!

The person would have to be a raving idiot if they haven't changed their FTP and email access on you. It'd be a safe bet that anyone not savvy enough to do so, would also not have backed up the site locally.

If you really don't stand a chance of seeing the money- delete the work you did as others suggested. As an added bonus, add some sort of message on the site warning others not to trust this person.

No matter what though, don't do anything stupid with their personal information.

Join them up (using their name or company name or whatever) on every embarrassing Yahoo group email list there is (they don't have the password, of course).

Every free trial and spam-bait ridden site that requires email registration.

Sleazy/kinky personal sites -- register the email with lots of strange partner preferences: "I like to be peed on by midget clowns...will settle for petite mimes."

etc. etc.

Advertise his personal ad everywhere...the personal ad that you will hand write...and publish it in 20pt font on his former web space.

I could go on for days but I really must be walking with my wife...

Take down his website, lock his server down tight so he couldn't put anything back up if he tried. Then tell him the site will be restored promptly upon payment.

Then sign him up for tons of spam

I did this recently (last Tuesday actually). That band that I did the web site for never paid me and then tried to squeeze me out of the site. They own the hosting account and changed the password to lock me out but I own the domain so I redirected the domain to a different site with a nice message explaining how they have screwed me over for the last year and a half. I also gave a nice warning to record labels explaining why they don't want to sign the band and then talked about how they have been selling CDs with a cover song for the past year and haven't paid royalties on it.

Needless to say they were pissed. I didn't ask for money (I can't anyways since that would be grounds for an extortion suit). Their lawyer called me but I wasn't afraid since it was their entertainment lawyer and he had no clue what he was talking about (he mentioned credit card fraud though, and that made me furious that he would accuse me of that). Plus this is a lawyer for a firm that has yet to make a dime off this client (an unsigned band), and therefore doesn't care much about protecting their interests. I took down the message to avoid the annoyances but the domain is parked and will NEVER point to their site. Today, over a week later they finally launched their own site

I no longer expected to see the money I was owed but I wasn't going to go down like that, not after all that work. I was tired of being treated like nothing by these guys who were supposed to be my friends, so I took matters into my own hands and I do not regret it.

I would say that for you it depends who the client is. You need to know exactly how they will plan on retaliating and if it is worth the possible legal battle. I know these guys and their abilities too well so I was confident in what I was doing but you may not want to do the same for a client you barely know.

I made the mistake of not removing my name from the whois info which made me an easy target for the band's fans on a message board. Luckily I've barely been contacted by them (if at all, I've ignored 2 suspicious IMs and that's it). That is the only thing I regret about all this.

Something to think about.

"A Shelby Township Web site operator is accused of trying to extort $300,000 from the county's primary law enforcement agency ó the Macomb County Sheriff's Office.

"Patrick Arthur Richard, 37, faces four felonies, including extortion, for allegedly holding the sheriff's office Web site hostage in exchange for money. Richard's Running Wolf Inc. operated the sheriff's office Internet site for nearly three years as a free service before shutting it down three months ago because the county wouldn't pay him."

I filed I small claims court, he thought i was bluffing, I mailed him the legal papers yesterday, he is nervous and calling me wanting to meet next week.

When I win and court he is ordered to pay. If he doesn't pay I can file to have him turn over his bank records and al his business records. If he still doesn't pay I can walk onto his property and claim whatever amount he owes me in his personal property.

It only costs about $50 to file a small claims case, $100 to go to court and you get the $100 back when you win.

It is well worth it.

Do you have any words of wisdom for people that don't want to get in to this situation?

I'm talking about (keeping good records etc.) I'm starting to do more small projects and wanted to know.
