Microsoft Warns Asian Govts of Linux Lawsuits
SINGAPORE (Reuters) - Microsoft Corp. warned Asian governments on Thursday they could face patent lawsuits for using the Linux operating system instead of its Windows software.
The growing popularity of Linux -- an open-code software that is freely available on the Internet and easily modified by users -- is a threat to the global dominance of Microsoft's Windows.
Linux violates more than 228 patents, Microsoft Chief Executive Steve Ballmer said at the company's Asian Government Leaders Forum in Singapore. He did not provide any details on the alleged violations, which the Linux community disputes.

So if Linux had been using technology 30 years before Windows... but Microsoft got a patent, Microsoft can sue Linux into the history books?
Sounds crappy.

Who is M$ gonna sue ?
Linux is NOT a company !
The source code is free and readily available, and M$ can do sh.t about it.

Incorrect.
There are several commercial releases of Linux, and several companies who do commercial infrastructure rollouts on Linux.
Anyways, it's not M$ doing the suing. It's SCO, with Microsoft's support.
EDIT:
Here is the exact quote:
There was a report out this summer by an open source group that highlighted that Linux violates over 228 patents. Some day, for all countries that are entering WTO (World Trade Organization), somebody will come and look for money to pay for the patent rights for that intellectual property. So the licensing costs are less clear than people think today.

Dear Steve Ballmer,
Give up. It is like fighting with water. You will get tired and drown.
