well the circumstances concerning the warning that was ignored is rather flagrant
if the warning was announced, thousands may have been saved

Sue countries? Under what jurisdiction? A US court has no jurisdiction over foreign countries. The UN may have some influence but ultimately unless there are lawsuits filed inside each and every country involved, the effort will be useless. Who the heck would you sue tho? I know in the US there is (i think) a separate agency that operates
And as for warning about the tsunami, didn't a lot of the areas that were devastated had no advanced warning system and likely couldn't afford one anyways? I think the news here said it was like $5 or $10 mill for one of those undersea sensors for tsunamis and that for the west coast of US there is a huge network of them and SE asia would need a network far larger than what the US has.

The Tsunami warning station in Hawaii that monitors the Pacific Rim sat and watched in horror as they realized that the quake would more than likely generate a devastating tsunami. The reason they watched in horror is because they had no way of issuing a warning to the countries surrounding the Indian Ocean. There was absolutely no infrastructure in place to notify the countries that would be effected. Keep in mind these are the people that monitor the pacific. TLC did a program that featured this. The guys that work in that station did what they could, which isn't much, and that wasn't their fault, not by a long shot.
From what I read immediately following the disaster, no one was too interested in spending money for a tsunami warning system in the Indian Ocean because having one is such a freak occurrence. No one thought it would happen, so the countries involved never put a plan in place to notify and evacuate the effected areas. And yet somehow a bunch of lawyers are thinking that the US bears some responsibility in that. I guess it's our responsibility to install tsunami warning systems in all oceans, even the ones that don't boarder our shores. Of course we don't have a warning system in the Atlantic, but we damn well should have had one in the Indian Ocean! And in hindsight, I would have gladly had the US spend the money to do so if it would have saved all those lives, but it was something that no one thought would happen there.
