PUNTA GORDA -- The general manager of River City Grill was arrested Monday after allegedly charging almost $1,200 at Rain Cafe to the debit card of a customer who had inadvertently left it behind at River City.

Aaron James Simon, aka Aaron Baldwin, 27, 18366 Burkholder Circle, Port Charlotte, was charged with criminal use of personal identification, fraudulent use of a credit card, uttering a forged instrument, forgery and grand theft. He was released from the Charlotte County Jail Monday on $12,500 bond.

Two Florida Highway Patrol troopers arrested Simon and brought him to the Charlotte County Jail. While there, one of the troopers asked Simon if he knew who the owner of the credit card was.

After Simon said "No," the trooper looked at Simon and said, "It was mine."


At least he didn't taser him.

Are you kidding? That guy will be a hero while in lockup. And if he has a clean record, he'll likely just get a fine and probation.

How can you be charged for "fraudulent use of a credit card" if he charged a debit card ?
The letter of the law would make him go free...

I have a debit card with the Visa logo on it. It works as either a debit or a credit card. I'd say his goose is cooked. Especially in THAT county.

No, that's not possible.

It's either or !

It's a credit card if you get a monthly statement that you have to pay off completely (e.g some Amex) or partially (MC, VISA).
It's a debit card if that charge automatically hits your bank's checking account.

The logo doesn't ay anything, both, debit and credit cards, can have a VISA logo.

Odds are the judge will state that the spirit of the law would include a debit card. That's the advantage of being a judge. You get to be the one to interpret the law... not morons on a forum.

Wrong. I have a card that I can either:
1) Enter my pin and have $$ removed directly
2) Sign the receipt (no pin) and have it show up on my monthly statement.

Debet card just means you can't take out more money than you have on your account, doesn't it?
