Contois Music Technology last week asked a Federal Court to stop the iPod maker from distributing its iTunes jukebox software and is seeking damages over an alleged patent violation by the iTunes software.

The suit, filed on June 13th in Vermont District Court, alleges that Apple's iTunes software design infringes on Contois' six-year old design patent (US Patent No. 5,864,868) entitled "Computer Control System and User Interface for Media Playing Devices." Contois is seeking a trial by jury.

Interesting how these guys wait until now...

Odd, given that Apple bought out the precursor (Soundjam) to iTunes? In that case, who would actually be liable?

Lawyers for Spink & Miller, PLC., the Virginia-based firm representing Contois, where out on business and did not responded to inquiries for comment by press time.
Apart from the typos in there ('where' ≠ 'were', dammit!), I read that as “Lawyers for [ ... ] Contois, were out of business...”

Well, good luck, Contois; I'm sure you'll get Apple to give up one of their greatest cross-platform software successes just like that. Be prepared for a fight (provided they actually turn out to have any kind of a case in the first place).

What defines a media playing device? Aren't modern computers media playing devices? Are they next going to go after software DVD players? Another overly broad patent strikes.

That was just the title of the patent. The actual patent itself would go into a little more detail...

Ahh... the joy of dumb patents. Again I think that you really should have to at least be doing SOME work towards your idea before you can patent something...

I doubt they hope to win. They probably want Apple to settle for some amount that's relatively paltry to Apple (especially compared to the hassle of yet another drawn-out trial) but which will keep the Contois folks in pot and Cheetos for a good long while. That's how a lot of lawsuits these days seem to be.
