What happens to unclaimed payroll checks in death?

So my Aunt passed away last month, and my family just recently received her last payroll check from her employer. Can we do anything with that as far as cashing the check without my Aunt's endorsement on the back of the check? Sure, I could fake it, but that would be bad.

If you think about it, you place beneficiaries on your Life Insurance and stocks, etc. at your place of business, but nothing is ever said about leftover payroll checks.

Anybody know?

Her executor can legally sign the check and deposit into her account in most states. sam

all checks can be deposited into a bank account of the named on front with no sig. simply write on the back, "for deposit only" and the aunt's account number. hopefully, like all smart people, there is a second name on the account. otherwise, it goes into the users estate and if no other name/etc...the courts/lawyers get involved.

Well, that's just it...my Aunt never married, so no other person was on the bank account. Plus, the bank account was closed shortly after the death.

I guess it will go into the state's probate.

gotcha. i'm not married/never have been; but i have another name on all my bank accounts. been thru the 'what to do now' too many times in the family; it is just smart financial sense. if you don't trust anyone, then well...that sux i have my parents on my accounts and i'm on all theirs (i'm also their P of A). i know, hind sight and all that...but...

banks should require it and make people do that at the time of opening an account

and oh, who still gets checks? direct deposit all the way.

also, it was suppose to become law here in michigan and well, goverment at its finest still dragging their feet.

Just deposit it, don't fake any signature, and see what happens.

That's what I would do. My bank has never even noticed I haven't signed some things.

And spending it on what? I think it would be a bit off if you took the cash and bought an Xbox 360 or something.

Umm, no. Was actually going to use the money to cover some of the extra unexpected funeral costs. I think that is fairly justified.
