Jury convicts HIV-positive man of sexual assault

A Lower Mainland man has been found guilty of aggravated sexual assault for having unprotected sex while he was HIV-positive, and not telling his partners about his condition.

Adrien Nduwayo, 36 was charged after six women claimed he had unprotected sex with them, all the while knowing he was HIV-positive.

Nduwayo admitted he never told the women he was HIV-positive, saying they never asked. And he said he did not believe he had a legal obligation to tell them.

Nduwayo also maintained he was careful to protect his sex partners, always wearing a condom. That contradicted the testimony by the women that he often did not wear a condom while having sex with them.

The B.C. Supreme Court jury in New Westminster took only a few hours to convict Nduwayo of five counts of aggravated sexual assault, one of attempted aggravated sexual assault and one of sexual assault.

"The decision sends a message that in respect to people who are infected with the HIV virus, that it is an aggravated sexual assault for them to have unprotected sexual intercourse with a woman without disclosing – or with a man for that matter – without disclosing the fact that they are HIV positive," said Crown counsel Andrew MacDonald.

MacDonald also praised the victims, saying they showed a tremendous amount of courage in coming forward to testify.

Nduwayo will remain in jail until he is sentenced at a later date.

Which brings up the topic, should people that have sexually transmitted disease be required under law to disclose there disease to partners. In Canada it is for diseases like HIV, I’m not to sure about other countries. I personally think groin tattoo should be mandatory for those who fail to do so like this guy, something like a big red circle. This guy is one of the few I would accept sending to the electric chair, and I’m very anti death penalty.

Rest of natural life per victim (in case anyone other bright spark gets it in their head to do the same to only one woman). It's murder we're talking about here.

A guy in Traverse City, Michigan did the same thing, but with 10 women. I think he got 15-20 years.

actually I was thinking about it, I think he should be deported, why waste money locking him up and medical on him. He came here in mid to late 90's

He should be shot in the head. Actually, no. His victims have to live with the fact that they will die in 15 years. Given the unthinkable act he commited, he should have to live without antiretroviral drugs. This way he'd have a sense of what a death sentence really feels like, since he doesn't seem to have any regard for human life right now, perhaps this would open his eyes.

When you knowingly give someone HIV (which eventually will turn into AIDS) what you are essentially doing is putting a bullet into the their head. The only difference is that the trigger won't go off for 15 years.

I just say deport him or lock him up. Everything is pointing to a commercially viable vaccine in 5 years for human trials. So I can’t support treating it as murder. I just say deport him. Why waste money on locking him up and giving him treatment.

about 3 of the 6, including one that has never slept with any one else. One also got pregnant. After he broke up with one of the woman, he called her a month later to tell her she should get a Aids test.
