Andrea Yates verdict: Not Guilty - INSANE
Andrea Yates not guilty by reason of insanity
Associated Press
HOUSTON — A Texas jury found Andrea Yates not guilty by reason of insanity Wednesday in the drowning deaths of her young children in the bathtub of their suburban home.
Ms. Yates will be committed to a state mental hospital, with periodic hearings before a judge to determine whether she should be released. If convicted, she would have faced life in prison.
Her lawyers never disputed that she drowned six-month-old Mary, two-year-old Luke, three-year-old Paul, five-year-old John and seven-year-old Noah in their Houston-area home in June, 2001.
But they said she suffered from severe postpartum psychosis and, in a delusional state, thought Satan was inside her and was trying to save them from hell.

Andrea Yates sits with her lawyer, George Parnham, after the verdict of not guilty by reason of insanity was read in her retrial on Wednesday in Houston. (Brett Coomer/AFP/Getty Images)
Ms. Yates did not react immediately as the verdict was read but then bowed her head and wept quietly.
The jury, split evenly between men and women, had deliberated for about 12 hours over three days before finding Ms. Yates not guilty by reason of insanity. The jurors had not been told that she would be committed to a mental institution for treatment if found not guilty.
Prosecutors argued that Ms. Yates failed to meet the state's definition of insanity: that a severe mental illness prevents someone who is committing a crime from knowing that it is wrong.
An earlier jury had found her guilty of murder in her children's deaths, but that verdict was overturned on appeal because of erroneous testimony. Prosecutors retried her on the same three counts of murder. Ms. Yates was not charged in the deaths of two of the children.

The BBC makes sound like she completely got off... which isn't really true. She will go to a high security mental facility until it's proven she can reenter society... which could be never.
I feel comfortable with this verdict.

Well, it's not as if being not guilty by reason of insanity is necessarily a great ruling for her anyway. Often times these people end up on the psych ward for 15 years or whatever.
EDIT:
mitchell beat me to it. Given mitchell's description above the it probably means more from him too.

Yates to become prisoner, regardless
7/23/2006, 9:47 p.m. ET
By SHEILA FLYNN and JAMIE STENGLE
The Associated Press
DALLAS (AP) — Whether she's convicted of murder in the bathtub drownings of her young children or acquitted by reason of insanity, Andrea Yates will likely spend the rest of her life as a prisoner.
If jurors agree with her plea of innocent by reason of insanity, Yates would be sent to a state-run, maximum-security mental hospital that would in no way resemble a country club.
Patients at Vernon State Mental Hospital in north Texas, where Yates would be initially sent, spend their days under orders, allotted only a small amount of daily free time, just like inmates in the state prison where Yates would spend the rest of her life if convicted.

If there was ever a case for the insanity defense, it was this. She had been previously diagnosed and had been on anti-psychotics.

I heard on my local radio station that the prosecutors only tried her for the deaths of four of her children in case this happened - they can still try her for the death of the fifth. Anyone have any corroboration on that front?

So, when the coroner picked up the children their arms and hands were rigidly outstretched, their fingernails in some cases half torn off (the oldest), and their hands were clenched and their neck muscles and face muscles clenched in grisly grimaces from the adrenalin in their bloodstreams and the amount of struggle that they went through prior to dying.
In fact, the bath water where she drowned them was full of feces, urine, and blood from their lungs, a bloody brown stew where she drowned each of them one after another.
She wasn't too insane to call police and admit she had done something wrong in killing her children.
I hope something very very horrible happens to her. She's a disgusting human piece of filth and I hope she goes someplace where someone takes care of business, so-to-speak, Jeffrey Dahmer style.

Yeah, it wouldn't have been so bad had she shot them in the head.

I also heard that. Sounds like quite a scam by the prosecution to me. I'm surprised they're allowed to do it just to get a free re-do.

If jurors agree with her plea of innocent by reason of insanity...
It's extra annoying when the AP gets it wrong. The verdict is either guilty or not guilty.

I know I shouldn't have posted that. I didn't say it as an attack on God - far from it! - but instead as a reminder that if God can love someone who did something so horrible, we should also. Love the sinner, not the sin... right?

At least I have the nads to admit how I feel, though. Not to get theological, but yes, God loves her as much as He loves any of us — but that doesn't mean I'm going to lie to myself and everyone else and deny that the human in me wants her to no longer exist on this planet after what she did.

Yes, I can respect that. I disagree with the sentiment, but I respect why you feel that way. I just tend to think the "eye for an eye" philosophy is outdated (in God terms).

Spoken like someone that has never dealt with a person with a mental illness.
I'm guessing she didn't just wake up one day and say "You know what... I'm a little tired of being a mom, so I think I want to murder my children and spend the rest of my life behind bars, or better yet, in a mental institution!"
I'm less forgiving for parents that kill their children due to drugs, alcohol or smoking.

You are trying to find reasons. She is just evil and should have been put to death a long time ago. Just like the guards in a concentration camp, they were evil and there is no excuse for their actions.

Cody, aren't you forgetting how mad you got at Tom Cruise for his rant about using antidepressants to treat postpartum depression? This is about a much more dangerous issue: postpartum psychosis. Andrea got crazy because of the events surrounding childbirth, and her family did almost nothing to help her. Because they didn't help her, they also didn't help the kids.
I think her husband is at least partly responsible for her problems AND for the deaths of their children. Why didn't he insist she see her doctor? Why did he let her listen to that psycho "preacher" in the first place? Why did he insist on a huge family, particularly when it was obvious from their first child's birth that Andrea was prone to psychosis after childbirth? Your listing of the conditions of the chldren's bodies is more about how psychotic the husband let her get WITHOUT doing anything to help her-and potentially protect their kids.
I also think that the jury in the first trial needs psychiatric evaluations; just reading the summary of the case gives a textbook example of a person who fits the legal definition (in Texas and about half the other states) of "not guilty by reason of insanity."

Nope, the Bible doesn't say God hates gays. It also doesn't say God hates murders, thieves, criminals, prostitutes, etc. There are plenty of people who think it does, and [ab]use the Bible in this way, though.

Let us refer to the FAQ on that one:
Doesn't the Bible say that God loves everyone?
No. You are probably thinking of John 3:16, which says no such thing. The word translated "world" in that verse (kosmos) NEVER means every individual of mankind who has ever lived (see, e.g., John 17:9). Romans 9:13 says that God hated Esau, and Psalm 5:5 says that God hates all WORKERS of iniquity (e.g., fags). Other examples are Proverbs 6:16-19, Psalm 11:5, and Malachi 1:3. Given these verses, how can you say God loves everyone? Can you really say "God loves everyone" when God says "I hated Esau?" Does God love the people in hell?
Or, you are thinking of "God is love." God certainly is love, toward His elect (His children). But He certainly is not love toward the reprobate (children of the devil). That's why His elect go to heaven, and the reprobate go to hell. In Romans 9:13, which says "As it is written, Jacob have I loved, but Esau have I hated", Jacob is a representative of God's elect, while Esau is a representative of the reprobate. In Romans 1, the word "reprobate" is used to describe fags. Fags are reprobate. God hates reprobates. Therefore, God hates fags.
Apparently the Swedes are in trouble too...

I love these guys
Why do you preach hate?
Because the Bible preaches hate. For every one verse about God's mercy, love, compassion, etc., there are two verses about His vengeance, hatred, wrath, etc. The maudlin, kissy-pooh, feel-good, touchy-feely preachers of today's society are damning this nation and this world to hell. They are telling you what you want to hear rather than what you need to hear, just like what happened in the days of Isaiah and Jeremiah: "That this [is] a rebellious people, lying children, children [that] will not hear the law of the LORD: Which say to the seers, See not; and to the prophets, Prophesy not unto us right things, speak unto us smooth things, prophesy deceits: Get you out of the way, turn aside out of the path, cause the Holy One of Israel to cease from before us." Isaiah 30:9-11; "Then the LORD said unto me, The prophets prophesy lies in my name: I sent them not, neither have I commanded them, neither spake unto them: they prophesy unto you a false vision and divination, and a thing of nought, and the deceit of their heart." Jeremiah 14:14; "They have healed also the hurt [of the daughter] of my people slightly, saying, Peace, peace; when [there is] no peace. Were they ashamed when they had committed abomination? nay, they were not at all ashamed, neither could they blush: therefore they shall fall among them that fall: at the time [that] I visit them they shall be cast down, saith the LORD." Jeremiah 6:14-15. And also in the New Testament we are warned: "For there are many unruly and vain talkers and deceivers, specially they of the circumcision: Whose mouths must be stopped, who subvert whole houses, teaching things which they ought not, for filthy lucre's sake. One of themselves, [even] a prophet of their own, said, The Cretians [are] alway liars, evil beasts, slow bellies. This witness is true. Wherefore rebuke them sharply, that they may be sound in the faith." Titus 1:11-13; "But there were false prophets also among the people, even as there shall be false teachers among you, who privily shall bring in damnable heresies, even denying the Lord that bought them, and bring upon themselves swift destruction. And many shall follow their pernicious ways; by reason of whom the way of truth shall be evil spoken of." II Peter 2:1,2. What you need to hear is that God hates people, and that your chances of going to heaven are nonexistent, unless you repent. What you need to hear is a little fire and brimstone preaching, like Jesus preached. What you don't need to hear is that you're okay just the way you are, and God accepts everyone without exception. Don't listen to the money-grubbing heretic who stands at the front of your church. Listen to God. If you are one of His elect, you'll hear.
and
Finally, Here is how much respect Jesus had for the funeral of an unrighteous man: "Jesus said unto him, let the dead bury their dead: but go thou and preach the kingdom of God". Luke 9:60. Jesus commanded a man, whose father had just died, to NOT EVEN GO MOURN AT THE FUNERAL AND BURY HIM, but rather preach the kingdom of God. Hypocrites in this modern era, who think they are smarter than Christ, would open their mouths in amazement at Christ's lack of respect for a poor mourning man whose father had just died.
