Yay! Abandoned software can now be legally archived and made available for download without risk of violating copyright or being thrown in jail. This paves the way for Underdogs (Macintosh Garden) and other sites that host abandonware.
I love downloading really old Mac, DOS, and Apple ][ games that I had a great time playing as a kid. I'm still amazed at the quality of those games give the hardware restrictions, then I'm amazed still further by all the crap that makes it to the store shelves.

ROMS yes, only if they are not readily buyable and usable on currently made hardware I think.
So any Nintendo roms that are of games that are on the Wii don't count for instance  .
Along with any atari roms atari still sells.

Depends. It sounds like the law says that if the game is in a format that makes it no longer readable, you can convert it so it works in another format. So if you are taking a ROM image of... say... the original NES version of Zelda, and running it in an emulator, that would be legal. The original NES version of Zelda cannot be read by any commercially available hardware.
If the Wii took your NES cartridge, this would be a different mater.

The point is they let you convert it because it is the content that matters, not the delivery device. If the content is available on the Wii, I bet Nintendo could push for that to count.
But I understand what you mean. Its a very debatable example.

The other thing I find interesting about this is if it would make Macintosh emulators entirely legal. You could argue that a classic Macintosh cannot be reasonable commercially obtained, and as such, you are free to distribute the ROM image from one in order to provide compatibility with older Macintosh software that can no longer be run.

Virtual Console is not that great on the Wii yet. It's selection is poor, and the virtual store needs work. Neither of those are problems with the console itself though. The virtual store is a web page, so that easily can be changed.
The emulation itself is perfect. I'm playing Mario 64 right now.
