Some privacy advocates are really coming down hard on gmail.com:

Is there anything to this, or is it just alarmist hype that is much to do about nothing?

That seems to be the point. All the articles I've read basically emphasize what "could happen" in light of Google's policy, but has it? Here's a different perspective:

I disagree.
Not all emails are sensitive enough to warrant encryption for everything.
I just don't want google to datamine me. I have a gmail accountonly as a spamcatcher and signup account.

I would be concerned in Google were doing something underhanded... I have no doubt at all that this kind of thing is disclosed in the eula. You agreed to it, and no one forced your hand. You were (and still are not) under any obligation to use gmail.
I think it's silly that people are upset about this. It's against the law for someone else to read your physical mail. Email doesn't and never has (thank goodness) fallen under government jurisdiction (that can probably be argued, but you get my point.) There's a price to pay with gmail. Frankly, I find the ads more useful than disturbing.

Considering I don't send emails about anything remotely illegal, I'm not the least bit concerned.
If they want to read my email from my great aunt about how the Cardinals won the World Series, they can be my guest.

As with pretty much everything in this life, you get what you pay for.
If you don't want Google to datamine you, don't use their services. Go somewhere that doesn't, and pay them instead.
