I believe it was only used in that blog article. I've had a photo published in Times Online as well. While both blogs are ad supported and major news outlets, I still feel that they are within the accepted boundaries of the CC NC licence term for me personally.
Is it really though? Even Creative Commons themselves are unsure, and are thus conducting a study where they will try and formalise the meaning of Non Commercial. The results are expected early this year.
Oh yeah, if I did wanted to sue them however, there has been a precedence, albeit involving print media.
