(April 2009) EFF and the law firm of Fish and Richardson filed an emergency motion to quash [pdf] and for the return of seized property on behalf of a Boston College computer science student whose computers, cell phone, and other property were seized as part of an investigation into who sent an e-mail to a school mailing list identifying another student as gay. The problem? Not only is there no indication that any crime was committed, the investigating officer argued that the computer expertise of the student itself supported a finding of probable cause to seize the student's property.
What made the student suspicious? He was known to be very computer knowledgeable and used not only the Boston College standard OS (must be Windows) but also (gasp) a super secret hacker OS that had mysterious white text on a black background.
Read the complaint - very lolworthy. It looks like they succeeding in getting the student off the hook, but it doesn't say much for the quality of learning being promoted at Boston College.

I've never really gotten a particularly good impression of Boston College. Of course my wife went to Boston University, so that might have had something to do with it... (Even at hockey games that aren't against BC, the BU students cheer '**** 'em up, **** 'em up, BC SUCKS!')

Police officers are, in general, NOT computer savvy and are seldom more than just a bit computer literate. That this student was doing something the officers didn't understand was probably pretty scary to them. Which means.......that maybe police officers investigating something related to computer use should be required to have a clue? I know, that's crazy talk.

Well, that and some campus administrator had told them that they had already "traced' the emails back to the student.

hey hey hey.
Reading the whole thing, it sounds like a roommate argument gone too far. All started when non-hacker roommates computer went kerflooey.

How about a heads up on what a CLI is for those of us who don't necessarily want to click?
