Every time I pay for my iOS Dev Program membership, Apple charges me the $99 plus my Massachusetts state sales tax. I don't get this? This is not a physical product, it's a membership. Mass state sales tax is specifically for physical tangible good, not memberships or services. I wonder what happens with the extra $5 they charge, do they keep it or unnecessarily send it to the state?

What is the sales tax?
The Massachusetts sales tax is 6.25 percent of the sales price or rental charge of tangible personal property 1 or certain telecommunications services 2 sold or rented in the Commonwealth.

2. Telecommunications services include telephone and other transmissions of information (such as beeper services, cellular telephone services and telegram services). Cable television and Internet access are exempt from the sales tax. Generally, the tax on the sale or use of telecommunications services is a tax on the transmission of messages or information by various electronic means, but not on the sale or use of information itself.

No.
I get OS X Seeds but that's because I'm an appleseed member, nothing to do with iOS dev center membership. All it is is a yearly fee that allows you to publish apps in the app store.

You get developer builds of iOS so you are getting a product.

But that's not something we're "buying". That is, we don't' own these developer builds, we are just getting access to them to help in our own work. They're still subject to licensing etc and aren't physical goods.

You don't "own" OS X; you buy a license from Apple, and you just happen to get a DVD copy of the binaries when you buy that license. That's how it works.
