Unable to delete HD; would like to do clean OS X install

Hi, I'm having a bunch of problems with my iBook and an Apple tech suggested I reinstall my OS. Now I know I can do a Software Restore instead but just to make sure I'm going for the clean install.
Well, how do I delete my HD so I can install OS X? I've tried booting from the Jaguar CD and running disk utility but it tells me I am unable to delete my HD because the disk is in use. Of course I'm unable to install OS X as it tells me that a newer OS is already installed.
I've done this in the past more than once. But I do not remember having this problem.

this is a strange problem, indeed! Are you sure the disk you were trying to initialize was the Hard Drive and not the CD Drive? There are a couple options in disk utility such as "erase disk" and the partitioning options, have you tried both of them?
I'll boot up from the 10.2 CD when I get home in a couple hours (if you haven't found a solution by then) and let you know if I find anything else that may be causing this in order to provide help.

Try restarting holding the option key, then choosing the OSX CD. If that does not work, insert CD, start up in hard drive, choose the CD as startup disk and restart.
Sometimes shutting down and rebooting does not unmount the volume so it registers as 'in use' upon reboot.

Thanks for all your suggestions. It seems the problem was I was booting from the Jaguar update CD. When I did the same from the OS X CD that shipped with my iBook I was able to delete the HD.
I've been updating and restoring files from Backup for the last 3 hours .....
