How to get rid of Desktop (Mac OS 9) alias??

So I installed Mac OS 9 on my iPod once to install something and then I reformatted my iPod and have wiped any trace of Mac OS 9 off my drives, but in my root list of folders in my computer I get this:

Applications
Desktop (Mac OS 9) ----Which is an alias, not a real folder
Developer
Library
System
Users

I've tried trashing the folder and I get "The item cannot be moved because you do not have sufficient privileges for some items", I've also done a sudo rm -r in the terminal and it erases it but anytime the Finder is restarted or the computer is restarted, the folder is recreated. It's not doing anything but it's annoying. Any idea on how to get rid of it for good?

Two ideas:

1. Delete the 'Desktop (Mac OS 9)' symlink and create a regular file there with the same name. Open it with XRay and make it invisible.

2. Edit the /.hidden file so that it 'includes Desktop (Mac OS 9)' in the list of items to hide.

These won't get rid of the file, but at least you won't have to see the damn thing anymore (I hate this thing too - I'd rather move it into a special folder I have called Classic which contains the Applications (Mac OS 9) folder, the System Folder, etc. but the damn system keeps making a new one at the root level of the drive whether I like it or not).

Repair permissions?

What are the permissions on your Desktop folder? (in Terminal, type "ls -ld ~/Desktop", and tell us what you get).
