Can't empty the trash

I have an empty folder that i used to store some files [can't remember what] a few weeks back and it's still sitting in the trash because when i go to empty the trash it says "the operation cannot be completed as New Folder is in use". There's nothing in the folder, is there a way i can see if another programs is calling the "new folder' for some reason so i can delete them both or is there another way around this one?

Open Terminal and delete the folder.

have tried rebooting and no joy will try using the terminal

1. Open Terminal.
2. At the prompt, type sudo_rm_-rf_ (where the underscores indicate SPACES)
3. Open the Trash and drag the folder into the Terminal window.
4. Hit return.
5. Enter the admin password when requested.

I bet you use Internet Explorer for some reason. If so, it's most likely caused by that, try this:

Nope don't use IE, its not even installed anymore.
Tried the sudo RM command (no good, told me the folder is not empty, tried again told it was an illegal option) and the doc at apple.com created a text file as it said it would but it just renamed the folder 'del0b2.001' and still the same problem! grrr
Do i need to unlink this file somehow?
