wait for dialtone not working in 10.3.8?

Since upgrading to 10.3.8 I've noticed that the modem setting to wait for dialtone before dialing doesn't seem to work anymore.

I use to get a no-dialtone message when my voicemail had messages, but now the modem in 10.3.8 dials anyways.

Anyone else experieence this? have solutions?
