they show how you can create to-do's and notes in Mail. They appear in the in-box and also in a notes folder in the side-bar. But can you have them NOT in the in-box and still in the side-bar. I like to keep my In box empty.

Nope. Notes and ToDos are associated with your mail-account and technically behaves as e-mails, which makes sense since the concept was taken from people who send themselves mails as reminders and notes.

In fact notes are just that: e-mails with this additional header:

X-Uniform-Type-Identifier: com.apple.mail-note

So am I stuck with the Note and To-Do's folders in the side bar ? I assume they are smart folders
or something.

Yes. You can think of them as smart folders I guess.
