I can understand a theme creator wanting to protect his hard work but really, unless swiz (or any other theme designer in a similar situation) is willing to hire a lawyer I don't see what anybody can do about these "unauthorized copies"

IP is meaningless unless you defend it, this is why Apple is seen as such a tight@ss when it comes to copies of their designs.

It's obvious the ones doing the copying don't care and swiz has already announced his retirement so he can't threaten to stop making themes... what else is there?

Well it's just the same as copying some painting, it's wrong and illegal.

From all that I have seen from this site in the past, it seems that they have always been all about imitating stuff made for the Mac. My view on this is that:
A.Usually they do a pretty good job of being copycats with products which do look quite close to the originals they copy;
B.The people who I care to have the respect of and who I want to know that I am the original author are Mac users, most notably everyone around here since I think it is quite obvious that aside from Izawa's close knit community, macnners are the most savvy OSX GUI people around.
