I'm liking Sen. Orrin Hatch. I have no idea if his name will ever be floated, perhaps I should get it out there. But I've always thought Hatch was an intelligent, decent, efficient man who cares deeply for the nation.

When I heard the sad news that Chief Justice Rehnquist passed away, for whatever reason, Hatch just popped into my head.

Your post was the first I'd heard of Rehnquist's passing.
Give petty people just a little bit of power and watch how they misuse it! You can't silence the self doubt, can you?

I doubt they're take a senator and put him/her into the Supreme Court. More likely it will be a judge of some sort.

More than likely, yes. But there IS a precedent for choosing from outside the ranks of judges.

Ya know, I was kinda lookin forward to a nominee named Clinton. (pick one)

Boy, this will be something. How many times has a president had 2 at the same time?

It'll almost be as good as FDR wanting to go to 13, so the New Deal could float.

Clinton? So you don't want someone fair in the court? I don't trust either of Clintons farther than I can throw them

The last time there were two openings at the same time was when Rehnquist was appointed. In 1971, and Justice Rehnquist was one of the Judges appointed (by President Nixon) to fill one of those vacancies.

Yes, it's the norm. In fact, as far as I am aware, Rehnquist was the first and only Chief Justice who was already on the Court as an Associate Justice.

Something to bear in mind in the next few months is this. The job of Chief Justice isn't especially more powerful than any other justice on the court. They are very much a club of equals. The only real additional power that the Chief Justice has is the administrative duty of assigning cases to a justice (or himself). That can have an effect on the way a case's opinion is written up, but it won't by itself generally change the outcome of a case. That's decided by the votes of all nine justices.

What I want to know is this. Will Chief Justice Roberts wear Rehnquist's Gilbert and Sullivan stripes on his robes?

AFAIK, there were two other associate justices who were "promoted" to chief justice, Justice White and Justice Stone.

Well, either Clinton would be just as fair as, say, Scalia/Thomas.

And, reguardless of politics, ya gotta admit, both brilliant legal minds. I mean like, "It depends on what the meaning of 'is' is?"

Saw an interview w/Sen Leahy, about Roberts. His take is he wants someone he feels would hear his case, or mine, or yours, or any American, fairly.
