Student Criminally Charged For Clogged Toilet

GREAT FALLS, Mont. -- Jesse Huffman insists he didn't do it on purpose, but the toilet he left plugged after "nature called" at this border crossing in north-central Montana has him facing criminal charges.

Toole County authorities charged the 19-year-old college student from Great Falls with criminal mischief after a border agent accused him of intentionally clogging the toilet.

Huffman said the clogged piping was completely unintentional, the result of an urgent, but natural bodily function.

"I've never been arrested before or anything like that, and I get arrested for taking a dump," said Huffman, a student at Montana State University in Bozeman.

Huffman was returning to Montana from a trip to Lethbridge, Alberta with four friends Saturday. Port authorities stopped their car for what was apparently a random search. The car's 19-year-old driver was cited for illegally possessing alcohol.

Huffman said he asked to use the bathroom while waiting for the driver.

A short time later, a port inspector discovered the toilet was clogged and threatened charges, Huffman said.

Cory Grayson, one of Huffman's friends, said he couldn't believe it when border agents first threatened charges.

"I didn't think they were serious at first, I was just laughing so hard," he said.

Port Director Larry Overcast said he could not comment on the case.

Huffman said he has hired an attorney and intends to fight the charge.

When I first heard this story, the first thing I thought was something besides fecal matter or toilet paper was flushed down the toilet. Could it be drugs???

Returning to the USA + border crossing + random search + illegal possession of alcohol + using the bathroom while waiting for the driver = 1/2 pound of weed flushed down the toilet???

Yeah, it definitely sounds suspicious. Once he was cited for illegal alcohol possession, they shouldn't have just let him go to the bathroom.

It's not a USA thing....

I would also argue that there is more to the story then we read here.

There is a difference between a toilet full of pooo and a toilet full to the rim with pooo and a ton of toilet paper (like intentionally clogging it).

And this is grounds for a charge of criminal mischief ?
What the heck is criminal about it ?

If he intentionally clogged the toilet (which a judge will decide), then he should get charged.

He should also have to pay to get it unclogged.

If I'm drunk and smash in to your car, shouldn't I get a DUI -AND- have to pay to fix your car?

i have friends who try and dissuade me when i have to use their toilets.

i've been known to plug those industrial type powerflush toilets.

This reminds me a bit of the case in Florida a few years back when a guy was arrested for an overdue library book. The police stopped his car for speeding or something, and his name came up in their database for having an overdue book, so he was arrested. Apparently this was Florida law. Wonder whatever happened to that case?

I guess it depends on what its clogged with. If he was flushing a "foreign" object then its likely he intentionally clogged it. Otherwise its simply absurd.

Yup. And sense we don't know what he was doing making any judgment about such a thing would be very "knee-jerkish"

I think it was more than a coincidence the guy asked to use the bathroom when he did, and suddenly the toilet was overflooded.

If it was THAT easy to do, it would be a DAILY event, and it probably wouldn't have raised any concerns.

I was at a house party at Michigan State when I saw the most disgusting fecal-related thing. It was a house with 10 guys living in it (not a frat), and their toilet was literally filled over the brim with s***. You couldn't even see water, just s***. One of the kids said the toilet broke, so they just filled it for the hell of it. I can attest that it wasn't a hoax - it smelled like s***. The strangest thing was that there was no toilet paper in the bowl. Makes you wonder if they wiped or not.

Anyways, I think those guys should get arreested before this kid.
