Is the disk image writable?

Well this works for Spotlight, but smart folders still don't see the comments. What a hassle.

Since Smart Folders use Spotlight, I don't see how that's possible.

Specifying comments does not seem to work for me at all, even though a general spotlight search does find them.
Give some files some comments. Then chose New Smart Folder from the Finder File MENU. Set it up to find Comments that contain your comments. nothing shows up. if you type your comments into a finder window search, or the spotlight menubar search, the files show up and you can save the search and it works. But try to add a comment field, and they go away again.
Check it out:
Try it.

Works fine for me. You didn't say what you were putting comments on though.

Post a pic of your smart folder specifying a functional search for comments. I'd like to see it. I've tried it with several types of files. Still does not work.
And you can see that I've commented the file in the background of the screenshots.

You're right, searching specifically for a comment doesn't work, but it does show up when I search through the spotlight menu.

You need to search for " Spotlight Comments", not just "Comment".

You're right, that works. what the heck are "comments"? I thought Spotlight comments were just renamed "comments".
Seems unnecessarily confusing to me.

I assume "comments" is intended for comments that are part of the file format (ie. stored within the file). A QuickTime movie can contain such a comment.

They are clearly labeled "Spotlight Comments" in the Finder's Get Info dialog.

yeessss.... but they used to be called just comments, hence my comment!
When I saw comments in the list for the smart folder I stopped looking. And don't get smarmy about that, it is pretty confusing especially if they are not going to tell you what the difference is.
