Who knows how it'll play out, but even Scalia had questions on the stifling of innovation that the lawsuit could bring. Interesting stuff, and this might not go the label's way.

Whatever else can be said about Scalia, he has pretty strict principles about what should and shouldn't be law, and he doesn't let his personal beliefs trump that. A properly-phrased argument should be able to turn him without much trouble. I think the labels are going to lose this one.
