permission is only needed if you are modding an existing theme. If everything is your own creation then no permission needed.

did you use any elements from another theme?

if you said "yes" then this is considered a mod

if you said "no" then this is an original theme which requires no permissions.

As far as any OS X themes go it looks entirely original to me, you're good to go man. Unless you knowingly borrowed ideas heavily or were influenced by a particular interface a whole lot then you need not worry.

You're a graphic designer, themers tend to follow the same rule of thumb: if you based your work on an existing design/artwork have you altered it enough to consider the resulting work your own? This may not be the best analogy to make when referring to theme creation and distribution because permission is always required before distributing a theme that contains an element created by another themer (unless of course the original "themer" is Apple, they just tend to get screwed over and over when it comes to this common-courtesy rule ).

Btw, nice mockup... grab Themepark and start pushing the pixels

Looks great i love thhe color scheme. my suggestion if you dont mind. would be to make it slightly plastic-y, or shiney? maybe i dunno. also once you finish that one the same style but with a sky blue, white, and black color scheme would look tight. anyway good work wish it was ready already but it of course takes time. good luck.

i like this a lot so far, especially the new colors - although i'm not sure about the progress bars - too flat.

come at you rapidly

I love the concept..but yeah..maybe the progress bars should have a little gloss to them..I don't really mind though.

This could come out to be a great theme

It does indeed look very nice.
I couple of things I would like to see improved:

Titlebars - I usually like tohave titlebars separated in some way or another from the rest of the window. You could use a line, or a different shade for the bottom part or something

Progress bars (just like jwill) - They are pretty flat. Perhaps if they were made to look something like the titlebars?

I think this could become a pretty cool theme, keep working

I downloaded an interesting wallpaper from Deviantart a while back but have yet to find a theme it really meshes with in my eye but this mock-up looks like it could be a nice match if you play up the flat elements more...

I don't know who made this wallpaper and the search feature over there is for subscribers only so I'm just going to post a 50% preview in the interest of giving you an idea.

The file on my drive is titled Tetsujin_01.jpg and I presume that's the original title as it's not the way I normally name things.

I don't know if modding your theme/mockup to be more like this would constitute a need for permission seeing as there is some similarity in color choice already and you're using flat elements not to mention yours is a theme vs. a wallpaper but I'll leave the ethical debate to others; I'm just providing a suggestion

Your mockup is an impressive start, both nice colour schemes and the orange is great.
We've had some dark glossy themes lately, and many people seem to like it... that's why I'd say Go for the Caf-au-lait.
It somehow reminded me of Orange Ghost from the latest MacThemes contest, but IMHO no reason to ask permission. Besides, your mockup has bigger potential (I liked the AvantGarde).
Have fun themeing

Tetsujin_01
I'd say this could make a well matching EYLO desktop.

i also suggest a gloss on the progress bars

Orange Ghost was my first attempt of making a mock-up. No regrets in finishing last, I learned a lot from trying. Indeed no reason to ask permission becuase it doesn't even look close i think. I just wish themepark would be easier coz I've made some other mock-ups that I'd like to finish for real...

This mock-up is soooo much better than mine was!!! No doubt about it.

very nice. especially the lighter variation. very uncluttered, very spare. perfect for a work environment unless of course it messes up the adobe tool palettes......

if its completed, i will use.

I love the colour combinations you've got for this design, both the original dark and lighter variant. Please make this theme!
