I know that we can expect exageration when new chips are introduced, but how can Apple claim near 40% speed increase when all that anyone else has claimed for this chip is a 5% increase over the core duo? That means its almost half again as fast as the old chip. This seems pretty unlikely!

To be fair, I think the "5%" numbers are when comparing chips of the same clock speed. Apple is likely comparing the 2.16 core duo (previous top end) to the 2.33 core 2 (new top end). On the other hand, 39% is probably generous as well.
15" MBP, 2.33 GHz C2D, 120GB HD, 2 GB RAM, OS X 10.4. 4GB iPod Nano.

They claim it based on SPECint_rate_base2000 for the 2.33GHz 17" MBP.
